Deed & Key is a service of Trainkeep LLC, a Utah limited liability company ("Deed & Key", "we", "us"), 7533 S Center View Ct Ste R, West Jordan, UT 84084. It helps Utah homeowners sell their own homes. This policy explains what information we collect through our website, our forms and our calls, texts and emails, and what we do with it. By using our site or sending us your information, you agree to this policy. If you don't agree, please don't use the site or send us your information.
We are not a law firm and not a real estate brokerage. What you tell us is not protected by attorney-client privilege, so please don't send us anything you need kept privileged, and don't send Social Security, bank account or card numbers through our forms or messages.
What we collect
Information you give us:
- Your name, email address and phone number when you ask us to contact you.
- The exact wording of the contact permission you agreed to, and the date and time you sent the form.
- When you send a privacy request: your name, the email or phone number you gave us, the type of request and any details you add.
- Anything you tell us in calls, texts, emails or other messages, such as details about your home and your sale.
- When you buy our service: your answers to our home form (such as who owns the home, its details, condition and repair history, your mortgage and HOA, your price and move date), the photos and documents you send us, and a record of your payment (the name and bank it came from, the amount, the date and any memo).
Information collected automatically:
- Which ad or campaign brought you to our site, when the link you followed carries that information (for example, the campaign name or a Facebook click ID).
- Technical information such as your IP address, browser, device, the pages you visit, the site that sent you and the time of your visit. Our hosting provider and the services on our pages receive this information, and it may appear in our technical logs.
Information from others: we may receive information about you from advertising platforms, such as which of our ads you saw or clicked, and from public sources, such as property records.
How we use it
We may use the information we collect to:
- Contact you by phone call, text message and email about selling your home and about our services.
- Provide the service you buy: prepare your documents and listing, track your deadlines, send your approved listing to the broker you choose, and keep records of your payment and any refund.
- Respond to your questions and requests.
- Run, maintain, secure and improve our site and services, including blocking bots, spam and fraud.
- Measure and improve our advertising, including finding out which ads work and showing our ads to people who may be interested.
- Keep records of your permission to contact you and of any request to stop.
- Comply with the law, respond to legal process, and establish, defend or enforce our legal rights.
- Carry out a merger, sale, financing or other business transaction involving our company.
- Create combined or de-identified information that no longer identifies you, which we may use for any purpose.
- Any other purpose we describe when we collect the information, or with your consent.
Calls, texts and emails
When you send our contact form, you agree that Deed & Key may call, text and email you about selling your home at the number and email address you gave us. You don't have to agree to buy anything. Message and data rates may apply. We may keep copies of texts and emails, keep notes of calls, and record calls where the law allows.
You can withdraw your permission at any time:
- Texts: reply STOP to any text from us. QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE also work. We may send one text confirming that you've opted out.
- Calls: tell us during any call that you don't want more calls.
- Emails: reply to any email from us and ask us to stop.
- Any of these: send a "Stop contacting me" request with the form below, or tell us in any other reasonable way.
We act on these requests within 10 business days. We may still contact you where the law allows, for example to answer a request you send us.
Who we share it with
We do not sell your personal information for money. We may share the information we collect with:
- Service providers that work for us, such as website hosting, data storage, bot protection, phone, text and email services, banks and payment services, and customer management tools. Today these include Cloudflare, which hosts our site and database and runs the bot check on our forms; Google, which runs our email; and JPMorgan Chase, which holds our bank account and receives Zelle payments.
- The broker, title company, attorney or anyone else you ask us to send your documents or listing to.
- Advertising and analytics partners, such as Meta (Facebook and Instagram), to measure our ads and decide who sees them. This may include your contact details in hashed (scrambled) form and information about how you reached and used our site.
- Our professional advisers, such as lawyers, accountants, auditors and insurers.
- A buyer, successor or other party in a merger, acquisition, sale of assets, financing, reorganization or bankruptcy involving our company, including while the deal is being negotiated.
- Courts, government agencies, law enforcement and others when we believe the law requires it, or when we believe sharing is needed to protect our rights, property or safety, or those of you or others.
- Anyone else, with your consent or at your direction.
Text messaging: we do not share your mobile phone number, or your permission to receive our texts, with third parties or affiliates for their own marketing or promotional purposes.
Cookies, pixels and similar tools
Some services on our pages collect information from your browser:
- Cloudflare Turnstile runs on our forms to check that a person, not a bot, is sending them. It processes signals about your device and browser, and your IP address.
We and our partners may also use cookies, pixels, tags and similar tools, such as the Meta Pixel and Meta Conversions API, to measure visits and ad results and to show you our ads on other sites and apps. You can block or delete cookies in your browser settings and manage ad preferences in your Facebook and Instagram settings; some parts of the site may not work as a result. Our site does not respond to "Do Not Track" or similar browser signals.
How long we keep it
We keep information for as long as we need it for business, legal or compliance purposes, and then delete or de-identify it.
We keep records of your permission to contact you, and of any request to stop contacting you, for at least five years. Claims about calls and texts can be brought years after they happen, and the law requires us to honor a request to stop calls for five years. Even after we delete your other information, we may keep your phone number and email address on a do-not-contact list so that we don't contact you again.
How we protect it
We use reasonable measures designed to protect your information. No website, storage system or transmission over the internet is completely secure, so we cannot guarantee the security of your information, and you send it at your own risk. If a security incident affects your information, we will notify you where the law requires.
Requests about your information
You can ask us to show, correct or delete the information we hold about you, or to stop contacting you, with the form below. Unless a law requires us to act on a request, whether and how we do so is up to us.
- We may ask for information to confirm your identity, and we may decline a request if we can't confirm it.
- We may decline or limit a request where the law allows, including when it is unfounded, excessive or repetitive, or when meeting it would affect someone else's rights.
- When we delete information, we may keep what we need to honor a stop request, prove permission to contact you, comply with the law, resolve disputes, prevent fraud or enforce our rights. Copies in backups may remain until they are overwritten.
Where a privacy law gives you specific rights, we will honor them as that law requires.
Children
Our site and services are not directed at anyone under 18, and we do not knowingly collect information from anyone under 18. If we learn that we have, we may delete it.
Where we operate
We operate in the United States and serve homeowners in Utah. We store the information you send us in the United States. If you visit from outside the United States, you understand that your information will be handled in the United States under its laws.
Other companies' sites and services
Our ads run on other companies' platforms, and our pages use services run by other companies. Those companies handle information under their own privacy policies, and we are not responsible for their practices.
Changes to this policy
We may change this policy at any time. Changes take effect when we post them on this page with a new "Last updated" date. If you keep using our site or services after that, you accept the updated policy. If a change materially affects information we already hold, we will give any notice or ask for any consent the law requires.
Governing law
This policy is governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law rules.
